Overview
Data Center Dynamics reported that East Fishkill, New York, passed a three-year data-center moratorium lasting until July 1, 2029, unless a data center is ancillary to an existing or permitted use and less than 20 MW or eligible for an Economic Development Special Permit. DCD said the freeze effectively stops a Treetop Companies proposal for a 1.16 million-square-foot data center south of Old State Road and Interstate 52, according to a drawing on the company’s website, but that Treetop never submitted a formal application. East Fishkill Supervisor Nick D’Alessandro said on Facebook there had never been an application for a data center and that data centers are not listed as a permissible use in the town’s industrial zones. WAMC reported that the Town Board unanimously adopted the freeze on June 26, 2026, after a Treetop Development proposal more than ten times the scale of the largest existing data center in New York, and that the proposal no longer appeared on the New York Independent System Operator interconnection queue. WAMC said the resolution bars data centers over 20 MW until July 2029, cites resident concerns about energy costs and groundwater quality near Superfund sites, and quoted residents saying they do not need a 1,000-megawatt data center. The Poughkeepsie Journal covered the same East Fishkill electricity-use debate around the Treetop-associated project.
The public map lists one map record, Treetop Development Data Center, 1,000 MW, planned. Reported campus capacity is 1,000 MW.
